1. DEFINITIONS

  • Company: BOOSTED MOONBOT PARTNER

  • User: Any individual or legal entity accepting this Public Offer Agreement

  • Platform: A cryptocurrency exchange with which the Company cooperates under referral programs

  • Referral Code: A unique code provided by the Company to identify Users during Platform registration

  • Cashback: A partial refund of commissions paid by the User to the Platform, funded from the Company's referral rewards



2. SUBJECT OF THE OFFER

The Company invites Users to register on Platforms using the provided Referral Code. Users are eligible to receive Cashback based on their trading activity, as determined by agreements between the Company and the respective Platforms.



3. TERMS AND CONDITIONS

3.1. Cashback is calculated based on commissions earned by the Company from the User's trading activity.


3.2. Cashback payment is subject to:


  • Submission of a request by the User

  • Signing a Cashback Confirmation Act or equivalent document

  • Compliance with applicable conditions


3.3. The Company retains the right to adjust Cashback rates based on its own revenues from the Platforms.


3.4. Cashback may be paid:


  • In cryptocurrency directly to the User's Platform account

  • Via wire transfer to a User's designated bank account, based on individual agreements


3.5. Users are solely responsible for all tax obligations related to Cashback receipts.


3.6. The Company may amend these terms at its sole discretion. Updated terms take effect upon publication on the website or direct notification to Users.


3.7. Cashback shall be subject to cancellation if, within six (6) months from the date it is accrued, the Company is unable to transfer such Cashback to the User using the details provided by the User, including where such details are insufficient and/or inaccurate for the relevant Platforms, or where, for any other reason related to such details, the transfer of Cashback is not reasonably feasible for the Company.



4. ACCEPTANCE OF THE OFFER

Acceptance of this Public Offer occurs when the User registers with a Platform using the Referral Code and participates in the Cashback Program.



5. REPRESENTATIONS AND WARRANTIES

The User represents and warrants that:


  • They have the full legal capacity to accept this Offer

  • They will not engage in any activity that would breach any applicable law or regulation



6. FORCE MAJEURE

The Company is not liable for failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, war, government acts, internet failures, or hacking attacks.



7. INTELLECTUAL PROPERTY

All trademarks, logos, texts, and other intellectual property rights related to the Company are the sole property of the Company. Users may not use such materials without prior written consent.



8. CONFIDENTIALITY

The Company and the User shall maintain strict confidentiality regarding all information exchanged under this Agreement, except where disclosure is required by law.



9. DATA PROTECTION

The Company processes personal data in compliance with applicable privacy laws. Details of data processing are described in the Privacy Policy.



10. DISCLAIMER

"Participation in the Cashback Program does not guarantee any specific earnings or outcomes. Services are provided "as is" without warranties of any kind."



11. ENTIRE AGREEMENT

This document constitutes the entire agreement between the Company and the User and supersedes all prior agreements and understandings.



12. SEVERABILITY

If any provision of this Offer is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.



13. NO WAIVER

Failure of the Company to enforce any part of this Agreement shall not constitute a waiver of its right to enforce it later.



14. ASSIGNMENT

The User may not assign or transfer any of their rights or obligations under this Offer without prior written consent from the Company.



15. TERMINATION

The Company reserves the right to terminate or suspend a User's participation in the Cashback Program at any time in case of violations of the Offer or suspected fraudulent activities.



16. GOVERNING LAW

This Offer is governed by and construed in accordance with the laws of the Cayman Islands. Disputes shall be resolved in the competent courts of the Cayman Islands.
